Pemberton was born about 1709, the son of Pemberton Claughton, Sr. and Anne Lewis. His father died soon after Pemberton was born and appears not to have left a will. His estate was inventoried March 15th, 1710. Anne remarried to Josiah Dameron, son of Bartholomew Dameron. Pemberton's grandfather, John Claughton, tried to gain guardianship in July of 1714 and appeared to be successful because in May of 1716 he was listed as guardian of Pemberton when he filed a suit against Josiah Dameron who married the relict of Pemberton Claughton, deceased, father of the orphan.

Pemberton married a woman he referred to as Griffin and had five sons and one daughter. Pemberton's name appeared on the Northumberland county rent rolls in 1748 and 1759.

Pemberton wrote his will April 8th, 1773 and appears to have signed with his own hand. The will was proven in court on July 12th of the same year. In his will he left his plantation containing 200 acres to his wife during the rest of her life and then to his son John. Pemberton, III received 50 acres of land that had been purchased from Thomas Myers that adjoined the land that he already lived on. The bequest was dependent on Pemberton, III making a deed of gift to his brother, Richard, for land in Richmond County to establish an estate. He left a plantation called "The Point" to his daughter Jane. James received a plantation in Richmond County. Pemberton Junior's will also revealed that he owned a mill in partnership with Pemberton, III. He gave his share of the mill and the slave that ran to mill to his wife. His will went on to list several more slaves by name as they were distributed among his children.
